- Abstract
- The article is disclosed the essence of economic categories "explicit collusion" (price fixing) and "tacit collusion" (concerted practice). We have established the reasons of occurrence and targeting of price fixing and concerted practice of producers; defined the methods of their establishing and maintaining, as well as conditions of their occurrence and viability; described the reasons of the existence of price fixing and define the economic features that distinguish them from the concerted practice. We identified the directions of perfection of methodical base of the antitrust law, consisting in а) expanding of the existing concepts of price collusion; b) using of economic analysis in the proof of price collusion. The received results can be used as a theoretical basis for developing a methodological framework of identify and prevent of price collusion of producers, taking into account the specifics of all forms of its expression, and also to quantify the need of antitrust reguäation of commodity markets.
